Studio Legale Padovan regularly assists construction companies and design specialists, both in Italy and internationally, in the context of highly complex public works and infrastructure projects, such as the design and construction of subways, railways, roads and highways, dams and power plants, hospitals, mines and industrial plants. Our end-to-end advice spans all phases of infrastructure projects.
In particular, we assist clients with their participation in tenders (including analysing tenders, evaluating requirements and drafting agreements, such as subcontracting and support agreements), advising in relation to the provisions set out in procurement contracts, addressing concerns and providing representation in any disputes arising with the contracting authorities, subcontractors or other parties involved in projects.
The firm also has considerable experience in private works contracts, and, in particular, the development of commercial and residential real estate projects. In this context we provide clients with assistance with drafting and negotiating contracts (where appropriate adapting internationally recognised models such as JCT, FIDIC and ICE to the Italian legal system), as well as with seeking urban planning authorisations and managing any related litigation.
Our considerable familiarity with the operating practices of international financial institutions (bilateral and multilateral) allows us to provide all-round support to construction companies competing in the international arena. The firm is an affiliate member of the Fédération Internationale Des Ingénieurs-Conseils (FIDIC) and a full member of the DRBF (Dispute Resolution Board Foundation), while our specialist professionals have an in-depth understanding of the application of FIDIC-based contracts and other related issues.
The team also has impressive expertise in the corporate aspects of infrastructure projects, joint ventures, special purpose vehicles, relationships between partners and between general contractors, and agreements with subcontractors and suppliers.
